The first step is preparing the Contract of Sale, which can then be provided to your nominated real estate agent. This contract includes the terms and conditions of the sale, including responsibilities and timeframes for each party. Once a buyer is confirmed and a price agreed upon, I prepare the relevant legal documents and help coordinate the next steps toward settlement.
Settle Petal Mobile Conveyancing also assists with liaising with your agent regarding special conditions or tenancy clauses if required. Where applicable, I coordinate with lenders or legal representatives to arrange for the signing of Discharge of Mortgage documents.

What is included in a contract of sale in NSW?
A contract of sale in NSW must include key legal and property details that outline the terms of the transaction. This typically covers the full names of the buyer and seller, property title information, purchase price, deposit amount, settlement period and any special conditions. It also includes mandatory disclosure documents such as a zoning certificate (Section 10.7), sewer diagram, title search and any restrictions, easements or covenants on the land. If it's a strata property, additional documents like the strata plan and by-laws are required. The contract must be prepared before the property is listed for sale.
What are the seller’s obligations during conveyancing?
Sellers are legally required to disclose accurate and complete information about the property. This includes providing a compliant contract of sale with all mandatory certificates, revealing any known issues (e.g. disputes, encumbrances or unapproved structures) and responding to reasonable requests for information. During the process, sellers must also ensure the property is vacant and in the agreed condition by settlement, and coordinate with their bank if a mortgage needs to be discharged. Failing to meet these obligations can delay settlement or give the buyer grounds to withdraw.
Is it free to use a JP for property-related documents?
Yes, using a Justice of the Peace (JP) is free in NSW. JPs are volunteers appointed by the state government to witness and certify legal documents, including those used in property transactions. This may include identity verification forms, statutory declarations or certified copies of ID and title documents. While you don’t pay for the service itself, availability can vary, and appointments may be needed depending on the provider. Some conveyancers offer in-house JP services for convenience, especially when urgent documentation is required for settlement.
